PLANNING COMMISSION MEETING MINUTES
AUGUST 18, 2015
EVENDALE MUNICIPAL BUILDING
The regularly scheduled meeting of the Evendale Planning Commission (EPC) was called to order by Chair Chris Patterson at 6:00PM on August 18, 2015. Attending were EPC members Mark Ferguson, Catherine Hartman, Jan Moore, Chris Patterson, and John Richey. Supporting the EPC were James Dobrozsi (Architectural Review Board Member), David Elmer (Assistant to the Mayor), James Jeffers (Village Engineer), Pam Morin (Building Department Clerk), Kathy Ryan (Legal Advisor), and Ralph Terbrueggen (Landscape Architect).
New Business:
1) White Castle, 3126 Exon Avenue
Site Review of Addition and Rezoning Required
Imaad Jaweed of Star Consultants presented plans for a 2,559 ft2 addition to the White Castle bakery on Exon Avenue. Ali Alghothani of Star Consultants and Jarrett Cook of White Castle Systems Inc. were also present.
Kathy Ryan noted the side yard setback at 9 feet is less than the 10 feet required. Mr. Jaweed explained that the drawing measurement is incorrect and that the building will be aligned with the current building which has a 10 foot setback.
James Dobrozsi inquired about screening of rooftop mechanicals and potential noise issues. The White Castle representatives agreed to provide proper rooftop screening. They said there will be no significant outside noise created by the new equipment but they could not state the specific dB level.
A discussion of building appearance and landscaping followed. The White Castle group agreed to remove or pave the gravel driveway off of Exon Drive and to improve landscaping along Exon Drive. They stated employment will not increase as a result of the addition, and therefore no additional parking spaces will be needed.
Chris Patterson asked for a motion to accept the site addition proposal with the following conditions:
1. Resubmission of drawings to confirm 10 foot setback.
2. Documentation of expected dB noise level.
3. Resubmission of drawings to confirm screening of rooftop equipment.
4. Resubmission of drawings to confirm removal or paving of the existing gravel driveway.
5. Resubmission of drawings to confirm addition of 2 or 3 trees along Exon Drive.
John Richey made the motion, Catherine Hartman seconded and the motion passed 5-0.
An additional issue of rezoning was flagged by Kathy Ryan. White Castle had previously expanded a rear parcel of the site in 2011. The expansion was approved by the EPC, conditioned upon rezoning of the land parcel from HC to GI. The rezoning mistakenly never occurred and was again missed in a 2013 zoning revision of the original parcel from GI to IF-2.
A motion was made by Catherine Hartman that the EPC initiate consideration of a zoning change on Parcel ID 611-30-208 from HC to IF-2. Mark Ferguson seconded, and the motion passed 5-0.
The EPC will conduct a public hearing on the matter next month and then issue an official recommendation.
2) Review Greg Dale service proposal for assistance with S. Reading Rd. Zone Study
This discussion was delayed until the next meeting.
Internal Business:
1) Information Sharing
David Elmer shared that Equity is continuing to pursue development of a restaurant with drive-through service (i.e. fast food) in the Village Crossing shopping center. The EPC noted that fast food restaurants are not allowed in this area and a variance for such is unlikely.
Miller Valentine has approached the Village about developing a 120 unit assisted-living facility in the Evendale Commons. Such use is prohibited in the PUD and Zoning Code, and the EPC agreed that David Elmer should discourage them from pursing this.
2) Approval of Minutes
Mark Ferguson moved to approve the minutes from the July 28, 2016 meeting, with a correction to the date of the meeting. John Richey seconded, and the motion passed 5-0.

The next regular meeting is scheduled for Tuesday, September 15, at 6:00 PM.
